I the undersigned (hereinafter “I”) hereby acknowledge that I am well acquainted and fully aware of and appreciate the real dangers and risks that are associated with walking, running and or riding on a game farm such as Belvedere Game Ranch (hereinafter referred to as “the farm”) and/or staying at the lodge or camping terrain situated on the farm (hereinafter herein referred to as “the lodge”) arising from the presence of wild and dangerous animals, reptiles, birds and insects and the real risk of suffering bodily harm, injury, death and/or loss to property which may arise as a result of an encounter with and/or the presence of other people, wild animals and/or reptiles and/or bird and/or insects whilst on the farm or in or at the lodge. *

This agreement and indemnity will be governed by South African Laws and legislation. As far as it is permissible by South African legislation I hereby waive all claims of whatsoever cause or nature howsoever arising (including claims for costs or damages, including attorneys’ fees incurred in instituting or defending claims, loss of life, personal injury or damage to property) against fellow guests, other riders, hikers or runners, invitees which I might have invited and the owners of the hunting farm and/or the lodge, their associates, guests, invitees, employees, servants, agents, assigns, officers,directors and/or any persons connected whether directly or indirectly with the running of Zulu Kingdom Trails and any other operations at the farm and/or the lodge arising out of harm, injury, death, or loss (of property, income and any other loss) suffered by me or by my guests, or invitees which I might have invited whilst on the farm and/or the lodge or concessions of the farm and/or the lodge and whether arising from an act of commission or omission on the part of those hereby indemnified or any one of them. *

I hereby indemnify and hold harmless and free, fellow guests and invitees which I might or might not have invited and the owners of the farm and/or the lodge, their associates, guests, invitees, employees, servants, agents, assigns, officers and directors and/or any persons connected whether directly or indirectly with the running of the farm and other operations at the farm and/or the lodge and fellow guests/invitees from any and all claims of whatsoever cause of nature (including claims for costs or damages, including attorneys’ fees incurred in instituting or defending claims, loss of life, personal injury or damage to property) which may arise on behalf of me, my spouse, common law wife/husband, my children, whether minor or adult, or relatives and/or persons accompanying me to the farm and/or the lodge and/or the trails whether as my invitee otherwise or at all who suffer injury or loss whilst on the farm and/or the lodge or concessions of the farm and/or the lodge and whether arising from an act of commission or omission on the part of those hereby indemnified or anyone of them. *

I hereby acknowledge that the riding of mountain and or other bikes, the running and or using of tracks (single or jeep) can be dangerous and is entirely upon the risk of the person who is visiting and or using these facilities and activities on the farm. I hereby undertake to use the trails responsibly and I hereby indemnify the farm and/or the lodge, from any and all claims of whatsoever cause or nature which may arise from the use of the trails by me. The terms and conditions of clause 2 and 3 above will apply mutatis mutandis to this clause 4. *

I hereby agree to the rules as displayed at the lodge and that is available on request, the contents of which I declare that I have read and understand, and undertake to abide by them. These rules, as amended from time to time, will form part of the agreement between myself and the owners of the farm and/or the lodge by means of incorporation and this reference thereto. I accept that any behaviour or conduct in contradiction to the rules may result in the immediate cancellation of my booking, lodging and riding trip together with the other consequences as I set out in the rules. In such an event I may and will be forced to leave the farm and/or the lodge immediately. I accordingly acknowledge that the right of admission to the farm and/or the lodge is and will remain strictly reserved by and in favour of the Owners of the farm and/or the lodge and or Zulu Kingdom Trails. *

I Acknowledge that this Waiver of Liability and Indemnity shall bind me personally, my executors, heirs, assigns and next of kin and be applicable to any and all accidents, injury, or event and I hereby personally accept all liability and responsibility for my actions. I declare that I also hereby assume liability under and in terms of this Waiver of Liability and Indemnity for or on behalf of my minor children, my guests, my agents and my employees who enter upon the farm or the lodge or who utilize the movables or who partake in the activities whatsoever on the farm or the lodge. I acknowledge that I have read, understand, and voluntarily sign this release Waiver of Liability and Indemnity, and further understand that no oral representations, statements, or inducements apart from this document have been made on behalf of the owners of the farm or the lodge. *

EXTREMELY IMPORTANT: I confirm that I am aware of the fact that this is an important document with terms and conditions which may affect my rights NEGATIVELY in more than one way. In view thereof, I declare that: I. I am aware of that and II. That I have read the terms and conditions and understand it or III. That I have not read it but never the less bind myself to it by affixing my signature to it beneath. **Delete 2 or 3 as the case may be. Thus done and signed at Belvedere, Magudu. *
